Since announcing the recall in July 2012, Stryker has offered two settlement programs to those who had already undergone revision surgery. The first was in November 2014 and the second in December 2016.
For those who have had revision surgery after December 2016, or have not had had a revision surgery, we expect Stryker will make a third offer sometime soon.
Approximately 5,000 Stryker Rejuvenate and ABG II Hip Lawsuits have been filed but approximately 20,000 Rejuvenate and ABG II hip device implants were sold. Under the first two settlement programs, thousands of Stryker hip implant patients received a base award of $300,000, subject to increases for additional injuries such as fractures and cabling or additional surgeries to remove hardware.
For many Plaintiffs, these settlement programs made good sense. For others with unique circumstances, they may have decided to opt out.
If you were implanted with a Stryker hip, you may still qualify for the settlement program regardless of whether your case has yet been filed. And, if you determine that these programs are not right for you, you will need a law firm experienced in representing opt-out Plaintiffs.
