More than 1,170 testosterone treatment lawsuits have been filed in the federal multidistrict litigation currently underway in U.S. District Court Northern District of Illinois, and cases continue to rise (In re: Testosterone Replacement Therapy Product Liability Litigation – MDL No. 2545).

As new cases are filed, the current federal case is moving forward. According to the recent March 17th status report, the parties are working to coordinate discovery and case schedules in the federal multidistrict litigation with the many pending state court cases, and document production by a number of defendants is well underway.

Testosterone Litigation

Testosterone lawsuits have been mounting in U.S. courts since January 2014, when the U.S. Food & Drug Administration (FDA) announced that it was reviewing the cardiovascular risks allegedly associated with testosterone therapy. Testosterone Plaintiffs accuse the manufacturers of testosterone related prescription drugs of deceptive marketing and a failure to warn patients and doctors of their potential to cause serious cardiovascular problems.

On March 3, 2015, the FDA announced that it will now require the drugs manufacturers to add information to their product labels detailing their potential to increase the risk for heart attacks and strokes. The FDA also expressed concern that these therapies are being used extensively to relieve low testosterone normally associated with aging, and reiterated that the benefits and safety of this use have not been established.
